New Limits Terms and Conditions – Digital Products and Services
These Terms and Conditions apply to the provision of services by New Limits Digital Pty Ltd (ABN 44 647 602 211) (New Limits, The Agency, we, us, our), including our related bodies corporate, to you as a user and customer of our services (you, your, The Client) and together referred to as the parties under this agreement (Agreement).
Appointments & Duties
The Agency shall perform the duties assigned to them to the highest professional standards and exercising the degree of skill and diligence normally exercised by similar professionals.
This Agreement is effective from the date this agreement is signed and will continue for a 90-day period, and then transition to a rolling month−by−month basis.
1. An invoice will be issued at the beginning of each billing cycle.
2. The initial invoice is due prior to on-boarding.
3. Subsequence invoices to be paid monthly on their due date.
4. Paid invoices are non refundable
The Client shall pay the full invoice amount to the Agency exclusive of any local taxes.
The Agency allow’s for 1 round of major revisions and 2 rounds of minor revisions. Work outside of the above will be billed at $150 + GST p/hour. Landing page will be delivered within 10-15 business days. The Agency may add the landing page to their online portfolio.
The Agency may subcontract the provision of the Services. New Limits will be responsible for the acts or omissions of its subcontractors
The Agency may record phone calls for quality & training purposes.
Confidentiality & Representations
The Agency shall not, either during or after the date of appointment under this Agreement, except in the proper course of their duties or as permitted by the Client, use or divulge to any person, organisation or corporate body any confidential information concerning the business of the Client.
Governing Law, Jurisdiction and Disputes
This agreement is governed by the law applying in Queensland, Australia. Each party irrevocably submits to the exclusive jurisdiction of the courts of Queensland, Australia and courts of appeal from them in respect of any proceedings arising out of or in connection with this agreement. Each party irrevocably waives any objection to the venue of any legal process on the basis that the process has been brought in an inconvenient forum.
